On Monday, October 6, 2025. the U.S, Supreme Court will begin its new session and important K-12 cases will once again be heard. With a Title IX case on its docket for this term the justices are expected to impact student civil rights issues, particularly in West Virginia v. B.P.J., which will answer the question of whether Title IX allows transgender students to play on sports teams aligning with their gender identities, or whether athletic teams must be based on sex assigned at birth. That case is already on the court’s schedule and it’s expected a number of other cases will make it there as well, especially those that will impact rights to free speech and religion.
K-12 issues have also made it to the court’s emergency docket, which consists of cases the court has granted for immediate review. Last year, court opined on two cases related to the Trump administration’s closing the U.S. Department of Education, with both rulings favoring the administration.
