The US Department of Education (USDE) appears to be nearing finalization of proposed Title IX regulations revisions after previously being delayed twice. On February 2nd, the USDE submitted a Title IX proposed rule on Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance to the White House and the Office of Management and Budget (OMB). The rule would direct how K-12 schools investigate and potentially punish sexual assault and harassment.

A second Title IX rule on transgender student participation in athletics that would prohibit blanket bans on transgender athletes participating in sports teams aligning with their gender identities has yet to be sent to the OMB.

The OMB oversees federal regulations and could take up to 120 days to review each of the proposed rules.
